Terms of Service

These terms (the "Terms") govern your use of the games and services published by Funzira, a brand operated by DigiForce LLC (Franklin, KY, USA) ("we", "us", "our"). This includes Echo (on the Meta Instant Games platform) and Among (a Discord Activity), together with any future games we publish under the Funzira brand (collectively, the "Games"). By accessing or playing any of the Games you agree to these Terms. If you do not agree, do not use the Games.

1. Eligibility

You must be at least 13 years old (or older where required by Discord, Meta, or local law) to use the Games. You are responsible for ensuring that your use of the Games complies with the laws of your jurisdiction.

2. Acceptable use

The Games are provided for personal, non-commercial entertainment. You agree not to:

• Cheat, exploit, modify, automate, reverse-engineer, decompile, or otherwise tamper with the Games or their network traffic;
• Attempt to gain unauthorized access to other players' accounts, the game server, or any related infrastructure;
• Use bots, scripts, or any automated means to play or interact with the Games (beyond the built-in AI bot feature provided by the host);
• Harass, threaten, impersonate, dox, or otherwise harm other players via in-game chat, voice, or display name;
• Post hateful, illegal, sexually explicit, or otherwise inappropriate content via in-game chat or any user-generated input;
• Use the Games to commit, facilitate, or promote illegal activity;
• Disrupt the Games or other players' enjoyment of them, including via spam, flooding, or denial-of-service attempts;
• Sell, trade, transfer, or attempt to monetize any in-game item, currency, or progression data;
• Misrepresent your identity or impersonate Funzira staff, Discord, or any other party.

The Games include host-controlled moderation tools (mute, kick) and a server-side profanity filter. We reserve the right, at our sole discretion, to remove access, terminate sessions, or ban Discord User IDs that violate these rules.

3. User content

You retain ownership of any messages you type into the Games. By submitting chat messages, display names, or other content, you grant DigiForce LLC a worldwide, non-exclusive, royalty-free license to process, broadcast, and display that content to other players in the same round, strictly for the purpose of operating the Games. We do not retain chat messages after they are delivered.

4. Virtual items and in-game currency

Among includes a virtual currency called "Bolts", virtual cosmetic items (hats, visors, pets, nameplates), an experience-point ("XP") and level system, achievements, and an ELO rating.

• These items have no real-world monetary value.
• They are not redeemable for cash or any other property.
• They are licensed, not sold, to you for use only within the Games.
• You may not transfer or sell them to anyone else.
• We may modify, reset, or discontinue them at any time, including for game-balance reasons, with or without notice.
• Seasonal cosmetic items are only available during their associated event windows. Items you own remain owned year-round but may not always be visible in the catalog.

5. Third-party platforms and services

Echo runs on the Meta Instant Games platform. Among runs on the Discord Activity platform. Your use of either Game is also subject to:

• Discord's Terms of Service and Privacy Policy when using Among;
• Meta's applicable Terms and Policies when using Echo.

We are not responsible for the availability, conduct, content, policies, or pricing of these third-party platforms.

6. Intellectual property

All Game content, source code, original artwork (including AI-generated cosmetic sprites we commissioned), trademarks, names, branding, gameplay design, and the "Funzira", "Echo", and "Among" marks are owned by DigiForce LLC or our licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, distribute, reproduce, create derivative works of, or publicly display any part of the Games without our prior written permission, except for personal screenshots and short clips shared on social media for non-commercial purposes.

7. DMCA / IP infringement claims

If you believe that material accessible through the Games infringes your copyright, please send a written DMCA notice to hello@funzira.com including: (a) your contact information; (b) a description of the copyrighted work and where the alleged infringement appears; (c) a statement that you have a good-faith belief that the use is unauthorized; (d) a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; (e) your physical or electronic signature.

8. Service availability

The Games are provided on a best-effort basis. We do not guarantee uninterrupted, error-free, or secure access. We may take the Games offline for maintenance, updates, or any other reason at any time, with or without notice.

9. Account termination

We may suspend or terminate your access to the Games at any time, with or without notice or cause, including (without limitation) for violations of these Terms. Terminated users may have their stored profile data (cosmetics, Bolts, XP, achievements, match history) deleted at our discretion. We are not liable for any loss of in-game progress or virtual items resulting from termination.

10. Disclaimer of warranties

THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE GAMES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGIFORCE LLC, ITS OWNERS, EMPLOYEES, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, IN-GAME PROGRESS, OR VIRTUAL ITEMS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GAMES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE GAMES OR THESE TERMS WILL NOT EXCEED FIFTY U.S. DOLLARS (USD $50.00) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on certain damages. In those jurisdictions, our liability will be limited to the smallest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless DigiForce LLC and its officers, employees, and contractors from any third-party claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Games, your User Content, or your violation of these Terms.

13. Dispute resolution

13.1 Informal resolution

Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at hello@funzira.com. We will attempt to resolve the dispute by negotiating in good faith for at least 30 days from the date you contact us.

13.2 Binding arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Games will be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that either party may assert claims in small-claims court if eligible. The arbitration will take place in Kentucky, USA, or in your home jurisdiction if remote arbitration is feasible. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

13.3 Class action waiver

You agree that any dispute will be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding. If this waiver is found unenforceable, the entire arbitration agreement will be void.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict-of-laws rules. Subject to Section 13, any court action must be filed in the state or federal courts located in Kentucky, and you consent to the personal jurisdiction and venue of those courts.

15. Modifications to the Terms

We may update these Terms at any time. Material changes will be reflected on this page with a new "Last updated" date. We may notify you of significant changes via an in-game banner or a notice on funzira.com. Your continued use of the Games after the change takes effect constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

17. Entire agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and DigiForce LLC with respect to the Games and supersede all prior or contemporaneous communications and proposals, whether oral or written.
